I don't think the quest in Brightwall is ever broken, but the gold trial is. I've managed to find the prisoner multiple times in more than one playthrough by searching inside the shops. The prisoner doens't always run from you and can be in the shop even after it closes. To arrest the prisoner just use the 'LT' button. (You won't be able to interact with him anyway.) Split or merge?[]
